Terms of use and licence
Sharing PDFs or logins is prohibited and unlawful.
Every report and every account is licensed to one named person. Forwarding, uploading or otherwise sharing a report PDF, screenshots or extracts of paid content, or your login or sign-in codes, breaches this licence and infringes our copyright under the Copyright Act, 1957. Using someone else's account is unauthorised access under the Information Technology Act, 2000. Both carry civil liability, and copyright infringement is also a criminal offence. Every PDF carries the licensee's identity, and we act on misuse. See section 4.
1. Who can use NBW Brain
- You must be at least 18 years old and able to enter into a binding contract.
- If you use NBW Brain for an employer or client, you confirm you are authorised to accept these terms for them. They are then bound too, and the licence is still for you alone.
- You must give a real email address you control. One account is for one person. You are responsible for everything done through your account.
2. What you buy
- A Brain (sold as research access) lets you read one report online, download its PDF edition and ask questions of that report's data, with source evidence, for three months from purchase. Questions are answered only from that Brain's evidence.
- Access is a one-time purchase. It does not renew automatically and you are not charged again unless you buy again.
- Free findings and report previews are available without payment. Some features need a free account.
3. Your licence
When you buy access, we grant you a personal, limited, non-exclusive, non-transferable and non-sublicensable licence to read and use the content you bought, for your own work and for the access period.
- You may quote short extracts, such as a finding or a chart, in your own internal documents and presentations, with the credit "Source: NBW Brain (NextBigWhat), [report title], [date]".
- You may keep PDFs you downloaded during the access period for your own reference. They remain under this licence after access ends.
- Free finding pages may be quoted publicly with the same credit and a link to the page. Publishing extracts of paid content outside your organisation needs our written permission.
- Need access for a team? Each person needs their own licence. Write to research@nextbigwhat.com for team or company licences.
4. No sharing of PDFs, content or logins
You must not, and must not let anyone else:
- share, forward, email, upload, post, sell or otherwise distribute a report PDF, or any copy, print, screenshot, recording or substantial extract of paid content, to anyone, inside or outside your organisation;
- put paid content on shared drives, intranets, chat groups, document-sharing sites or public websites;
- share your account, sign-in email, one-time codes or signed-in session, or use anyone else's;
- remove or alter the licensee name, date or notices on a PDF or page;
- get around the paywall or access controls, or copy content by scraping, bots or other automated means;
- use paid content to build a competing product or database, or to train or fine-tune an AI model.
These acts are unlawful, not only a breach of contract. Our reports, charts, data compilations and the Market Brain are protected as literary works and compilations under the Copyright Act, 1957. Copying or distributing them without a licence infringes our copyright (section 51). Infringement exposes you to civil remedies, including injunctions, damages and accounts of profits, and is a criminal offence under section 63 of that Act. Accessing NBW Brain through another person's account, or helping someone do so, is access without the owner's permission under the Information Technology Act, 2000, which carries liability to pay compensation (section 43) and may be an offence (section 66).
If we find sharing or misuse, we may do any or all of the following:
- suspend or end the access of everyone involved immediately, without refund;
- charge the licence fee for each person who received or used the content without a licence;
- take civil action and file criminal complaints under the laws above.
Every PDF edition is stamped with the licensee's email address and issue date. We log sign-ins and downloads to detect shared accounts, as described in our privacy policy.
5. What the research is, and is not
- NBW Brain research is built from what consumers (buyers and borrowers) say they did and why, in their own words, together with dated product listings, company and lender filings and independent market research. It is not purchase or lending data and not a representative survey. Shares describe the evidence, with the base shown.
- It is research to inform your judgement. It is not investment, financial, legal, medical, nutritional or other professional advice, and it is not a recommendation to buy or sell any product or security.
- We work to make it accurate, but we do not guarantee that it is complete, current or error-free. Decisions you make with it are yours.
- Brand and product names belong to their owners and are used only to describe the market. Their mention is not an endorsement by or of them.
6. Chat with the data
- Answers are generated by AI from our evidence base. They can be incomplete or wrong, so check the evidence shown with each answer before relying on it.
- Do not enter confidential or personal information about others in your questions.
- Answers are part of the paid content and are covered by the licence and sharing rules above. Fair use applies: up to 100 questions in any 24 hours per account, and no automated or scripted questions. We log questions asked, with the time and device, to enforce this and the one-person licence.
7. Prices, payment and tax
- Prices are shown in Indian rupees. For payments through Razorpay, 18% GST is added and shown before you pay. Your invoice is available in your account as soon as payment is confirmed; companies can add their GSTIN, address and PO at checkout for a GST invoice in their name.
- Time-limited offers show the full price, the offer price and the date the offer ends. The full price applies after that date. You pay the price shown at checkout when you pay.
- A coupon code comes off the price at checkout, after any running offer, and each code can be used once per reader. Codes cannot be exchanged for cash.
- Payments are processed by Razorpay, or by Stripe where offered. Stripe payments are charged by our affiliate Zakti, Inc. (USA). We do not see or store your card or bank details.
- Access starts when your payment is confirmed. Refunds are covered by our refunds, cancellation and delivery policy.
8. Our intellectual property
All content on NBW Brain, including reports, findings, charts, data, text, design, software and the Market Brain, is owned by Zakti Techmedia Private Limited or its licensors. NextBigWhat and NBW Brain are our trademarks. Apart from the licence in section 3, no rights are granted to you.
9. Acceptable use
Do not misuse the site: no attempts to break security, overload our systems, introduce malicious code, impersonate others or break any law. We may suspend accounts used in these ways.
10. Suspension and termination
You can stop using NBW Brain at any time. We may suspend or end your access if you breach these terms, if we are required to by law, or to protect other users or the service. Sections 4, 5, 8, 11, 12 and 14 continue to apply after your access ends.
11. Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or business decisions made using the research. Our total liability to you for any claim is limited to the amount you paid us for the access concerned in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
You agree to compensate us for losses, costs and reasonable legal fees arising from your breach of these terms, including any sharing of content or logins.
13. Changes to these terms
We may update these terms. We will post the new version here with a new date and, for material changes, tell signed-in users. Continuing to use NBW Brain after a change means you accept it. Access you have already bought keeps the licence scope it was sold with.
14. Governing law and disputes
These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from them or from your use of NBW Brain.
15. Contact and grievances
Questions, complaints or reports of misuse: research@nextbigwhat.com. We acknowledge grievances within 24 hours and aim to resolve them within 15 days.
